1. Scope & Provider
These Terms of Service ("Terms") apply to all orders and contracts concluded via the Kylie & Marli Sydney online store (the "Online Store"). Policies referenced on our site (e.g., Privacy Policy, Shipping & Delivery, and Returns & Refunds) form part of these Terms.
2. Formation of Contract
- Product listings are an invitation to treat, not a binding offer.
- By placing an order at checkout, you make a binding offer to purchase the items in your cart.
- A contract is formed when we confirm your order by email. We may decline or cancel an order (e.g., suspected fraud, pricing/stock error). If payment was taken, we will refund promptly.
3. Prices & Payments
- Prices are displayed at checkout (typically in AUD) and exclude shipping and any import duties/taxes payable in your country.
- Applicable shipping costs are shown before you complete your order.
- We accept the payment methods shown at checkout (e.g., credit/debit cards, PayPal, other Shopify-supported options). Payment is captured when you place the order.
- We may use automated and/or manual checks to reduce fraud.
4. Delivery & Shipping
We ship worldwide, including Australia. Orders typically process within 1–3 business days. After dispatch, typical transit time is 5–12 business days, depending on destination and carrier. Remote areas may take longer.
- Shipping costs depend on size, weight, and destination and are shown at checkout.
- You will receive a shipping confirmation with tracking when your order leaves our warehouse.
- Risk passes on delivery to the address provided (or to your chosen carrier where applicable). See our Shipping & Delivery Policy for details.
5. Returns & Refunds
- Items must be unused, undamaged, and in original packaging with tags.
- Change-of-mind returns: customer pays return shipping to our Asia-based fulfilment centre.
- Defective, damaged or incorrect items: contact us within 7 days of receipt with photos and your order number — we will cover return shipping or send a free replacement.
- For hygiene reasons, returns are not accepted for underwear and bras/intimates (final sale).
- Refunds are issued to the original payment method after inspection (bank/card processing times vary).

6. Warranty & Liability
- Statutory consumer rights apply. We warrant goods conform to the contract at delivery.
- Australian Consumer Law (ACL): Our goods come with guarantees that cannot be excluded. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage; you are also entitled to have the goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
- To the maximum extent permitted by law, we are not liable for indirect or consequential losses (e.g., loss of profits, data). Our aggregate liability related to a purchase is limited to the amount you paid for the product(s) concerned. Nothing limits liability where unlawful to do so (e.g., death/personal injury caused by negligence, fraud).
7. Privacy
We process personal data according to our Privacy Policy, which explains purposes, legal bases (including GDPR/DPF/SCCs where applicable), retention, and your rights.
8. Governing Law & Jurisdiction
These Terms are governed by the laws of New South Wales, Australia, without prejudice to any mandatory consumer protection laws of your country of residence. Courts of New South Wales (Sydney) have jurisdiction, unless mandatory law grants you the right to bring claims in your home jurisdiction.
9. Changes to These Terms
We may update these Terms by posting a new version on this page. The Last updated date at the top shows the latest revision. Continued use after changes constitutes acceptance.
